Overview

These Terms and Conditions set out the public terms for using BondiByte websites and the BondiByte SaaS software platform, unless a separate written agreement, order form, checkout flow, invoice, or subscription agreement applies.

BondiByte is software provided as a hosted SaaS platform for NDIS provider operations. It supports workflows such as staff, clients, sites, rosters, timesheets, invoice drafts, documents, audit evidence, automation, notifications, and account controls.

By accessing or using BondiByte, the customer and each user agrees to these terms. If you do not agree, do not use the platform. These terms were last updated on 20 June 2026.

How BondiByte works with your team

BondiByte is an operational software tool, a decision-support and administration aid for NDIS providers. It is not a substitute for professional judgement, qualified advice, your own policies, or required human review.

Automation and smart features do the heavy lifting and prepare drafts and suggestions to save your team time. You stay in control: you review automated activity and outputs when needed, and decide what to approve, send, or rely on.

BondiByte does not provide legal, clinical, medical, financial, accounting, tax, payroll, industrial relations, or NDIS-compliance advice, and it is not an emergency, monitoring, or life-safety system. Always confirm requirements with the relevant authority and your own qualified advisers.

Using BondiByte

Customers and users must use BondiByte only for authorised business and operational purposes. The platform is intended to support provider operations, not to replace professional judgement, customer policies, or required review processes.

Customers control what their authorised users review, approve, send, publish, export, or rely on inside their workspace.

• Use the platform consistently with applicable law and provider obligations.
• Review operational outputs before relying on them.

You stay in control

BondiByte includes automation and smart features, including Smart Rostering, scheduled roster automation, reminders, timesheet and invoice draft preparation, document scans, and audit workflows. These features are there to save your team time, while keeping your team in control of the decisions that matter.

You decide how much to automate, and you review automated activity and outputs when needed rather than at every moment. Manager review and approval steps are available so the right people can check work before it goes out.

• You remain responsible for the decisions made in your workspace, including work that automation prepared or sent based on settings you chose.

Reviewing automated outputs

BondiByte prepares drafts and estimates to speed up your work, including Smart Rostering results, timesheet and invoice drafts, pay and cost calculations, NDIS claim data, budget figures, audit and Practice Standards mapping, and reports.

Before you rely on these for payroll, billing, or NDIS claiming, review and confirm them against your own records and the current authoritative sources, such as the relevant awards and the Fair Work system, and the current NDIS Pricing Arrangements and Price Limits.

To the extent permitted by law, BondiByte Robotics is not responsible for loss arising from outputs that are relied on without being reviewed, such as overpayments, incorrect claims, or pay errors.

No professional advice

BondiByte is software, not advice. Nothing in the platform, its outputs, templates, catalogue data, pricing data, pay levels, audit mapping, guides, or website is legal, accounting, tax, payroll, industrial relations, clinical, medical, disability-support, risk, audit, or NDIS-compliance advice.

Features that reference external frameworks, including the NDIS Pricing Arrangements and Price Limits, the NDIS Practice Standards, the NDIS Code of Conduct, awards, or payroll rules, are provided as tools to help you organise your own work. They may not be complete or current, and they do not guarantee compliance, registration, payment, or any audit outcome.

You are responsible for obtaining your own professional advice and for confirming current requirements directly with the relevant authority, including the NDIS Quality and Safeguards Commission, the National Disability Insurance Agency, the Fair Work Ombudsman, and the Office of the Australian Information Commissioner.

Not for emergencies or critical safety

BondiByte is an administration and operations platform. It is not a medical device, not a clinical system, and not an emergency, duress, monitoring, or life-safety system.

Do not rely on BondiByte, or on its notifications or reminders, for emergency response, urgent clinical or care decisions, medication management, incident response, or the immediate safety of any person. Keep separate, independent processes for these needs.

Notifications and reminders

Notifications, reminders, and emails depend on configuration and on third-party delivery, so like any email they can occasionally be delayed or filtered.

For time-critical obligations such as document, clearance, qualification, insurance, or agreement expiries and renewals, it is good practice to keep your own tracking as well, rather than relying on reminders alone.

Accounts and access

Customers are responsible for deciding which people receive access to their BondiByte workspace and for maintaining appropriate role assignments, staff links, auditor invites, and account status.

Users must keep login details secure and must not share credentials, invite links, auditor links, or workspace access with unauthorised people.

Customer data and responsibilities

Customers are responsible for the accuracy, quality, and legality of the information entered, uploaded, approved, or sent by their organisation and users.

Customer data may include staff, client, site, document, roster, timesheet, invoice draft, service agreement, incident, audit evidence, support, billing, and configuration information entered or managed by the customer.

• Only upload information the organisation is authorised to store and use.
• Manage user access when staff roles, employment, or responsibilities change.
• Check operational records before approval, publication, export, or sending.

Your compliance responsibilities

You are solely responsible for your organisation's compliance with all laws and obligations that apply to your operations. BondiByte helps you organise and run your operations, but using BondiByte does not make you compliant and does not transfer any of your obligations to BondiByte Robotics.

• NDIS Act, NDIS Practice Standards, NDIS Code of Conduct, and NDIS Quality and Safeguards Commission requirements, including registration and audit.
• NDIS pricing, claiming, plan management, and record-keeping requirements.
• Employment, workplace, award, pay, and Fair Work obligations.
• Work health and safety, incident, and reportable incident obligations.
• Privacy, confidentiality, consent, and data-handling obligations for personal and sensitive information.

Electronic signatures

BondiByte provides an electronic signature tool to send documents, such as service agreements and staff contracts, for electronic signing, and to store a snapshot of the signed document.

You are responsible for deciding whether electronic signing is appropriate for a given document and signer, for the identity and authority of signers, for obtaining any required consent to sign electronically, and for meeting the requirements of the Electronic Transactions Act 1999 (Cth) and its State and Territory equivalents. Some documents may be excluded from electronic signing by law.

BondiByte Robotics provides the signing tool only and does not warrant the legal validity, enforceability, admissibility, or sufficiency of any document or signature. The content of templates and documents is your responsibility.

Third-party services and integrations

BondiByte relies on, and can connect to, third-party services, including hosting and infrastructure, identity providers and single sign-on, email delivery, payment processing, and payroll or accounting exports. These services are provided by their own providers and governed by their own terms.

BondiByte Robotics is not responsible for the acts, omissions, availability, accuracy, or security of third-party services, or for data once it is exported to or handled by a third-party system that you choose to use.

Subscription plans, trials, and billing

Published plans may include trial-led entry, subscription purchase paths, and custom Enterprise arrangements. Billing is described further in the Billing Terms.

Billing terms may be supplemented by an order form, approved checkout flow, invoice, subscription agreement, or other written commercial terms. Final payment and subscription handling may be completed through the approved billing process when enabled.

Acceptable use

Use of BondiByte is also governed by the Acceptable Use Policy. Customers and users must not misuse the website, platform, files, notifications, automation, auditor links, or access controls.

• Do not attempt unauthorised access, or to reach data you are not authorised to use.
• Do not upload malicious, unlawful, misleading, or unauthorised content.
• Do not use automation, notifications, or audit links to harass, spam, disrupt, or disclose information without authority.

Availability and product changes

BondiByte Robotics may maintain, update, improve, or change the website and platform over time. Product areas may be added, changed, paused, or retired to support security, reliability, customer needs, or product direction.

Unless a separate written service level agreement applies, public website wording should not be read as a specific uptime guarantee.

Disclaimer of warranties

To the maximum extent permitted by law, and subject to the Consumer guarantees and Australian Consumer Law section below, BondiByte is provided on an "as is" and "as available" basis, without warranties or representations of any kind, whether express or implied.

BondiByte Robotics does not warrant that the platform will be uninterrupted, error-free, or secure from every threat, or that any output, calculation, suggestion, mapping, or record is accurate, complete, current, fit for a particular purpose, or sufficient to meet your obligations. You are responsible for determining whether the platform is suitable for your needs.

Intellectual property

BondiByte Robotics owns or licenses the website, platform, product design, software, branding, documentation, templates, and other materials made available as part of BondiByte.

Customers retain responsibility for their own customer data and uploaded content, subject to the rights needed for BondiByte Robotics to provide, secure, support, and improve the service.

Limitation of liability

Subject to the Consumer guarantees and Australian Consumer Law section below, and to the maximum extent permitted by law, BondiByte Robotics is not liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, savings, goodwill, business, opportunity, or data, however arising.

Without limiting the above, BondiByte Robotics is not liable for loss or liability arising from reliance on unreviewed, unverified, or automated outputs, from failure to supervise or review automated or scheduled features, from the accuracy, content, or legality of your data, from your compliance decisions, or from third-party services.

To the maximum extent permitted by law, the total aggregate liability of BondiByte Robotics arising out of or in connection with the platform and these terms is limited to the amount of subscription fees paid by the customer for the platform in the twelve months immediately before the event giving rise to the liability.

Indemnity

To the extent permitted by law, the customer indemnifies BondiByte Robotics and its personnel against claims, liabilities, losses, costs, and expenses arising out of or in connection with the customer's data and content, the customer's use of the platform, any breach of these terms or the Acceptable Use Policy, any failure to supervise, review, or verify automated features and outputs, any infringement of third-party rights, and any breach of the customer's legal or NDIS obligations.

Consumer guarantees and Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

Where the Australian Consumer Law applies and permits a supplier to limit its liability for a breach of a non-excludable guarantee, the liability of BondiByte Robotics is limited, at its option, to re-supplying the relevant services or paying the cost of having them re-supplied.

Suspension and termination

Subject to applicable law and any written agreement, BondiByte Robotics may suspend or restrict access where needed to address payment issues, security concerns, misuse, unlawful activity, platform disruption, or risk to other customers.

Customers may cancel or end a subscription according to the applicable billing terms, order process, subscription agreement, or written arrangement.

Governing law

BondiByte is provided by BondiByte Robotics Pty Ltd (ACN 699 516 231), a company registered in Queensland, Australia.

These terms are governed by the laws of the State of Queensland, together with the applicable laws of the Commonwealth of Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that place.
